Terms of Service

Welcome to Cythr. These Terms of Service ("Terms") govern your use of the Cythr mobile application and related services (collectively, the "Service"). By creating an account or using Cythr, you agree to be bound by these Terms.

1. Description of Service

Cythr is a free cycle-tracking application that provides:

• Menstrual cycle tracking, predictions, and phase analysis
• Symptom and mood logging
• AI-powered smart logging and health insights
• Partner sharing features for collaborative tracking
• Medication and wellness reminders
• Gamification features (quests, achievements, pixel avatar)

2. User Accounts

To use Cythr, you must create an account. You agree to:

• Provide accurate and complete registration information
• Keep your login credentials secure and confidential
• Notify us immediately of any unauthorized access to your account
• Be responsible for all activity that occurs under your account

You may sign up using email/password or through third-party providers (Google, Apple). You must be at least 13 years old to create an account.

3. Health Information Disclaimer

Cythr is not a medical device. Cythr is not designed, intended, or approved as a medical device as defined by any regulatory body, including but not limited to the U.S. Food and Drug Administration (FDA), the European Medical Device Regulation (EU MDR), or any equivalent authority in any jurisdiction.

Cythr does not diagnose, treat, cure, or prevent any disease or medical condition. The cycle predictions, AI-generated insights, and health information provided by Cythr are estimates based on user-entered data and statistical algorithms. They are not clinically validated and are provided for informational and educational purposes only.

Cythr is not a substitute for professional medical advice, diagnosis, or treatment. You should always consult a qualified healthcare provider before making any health-related decisions, including but not limited to decisions about contraception, fertility planning, or the diagnosis and treatment of health conditions.

Do not rely on Cythr as a method of contraception or fertility planning. Cycle predictions are algorithmic estimates that may be inaccurate. If you are trying to conceive or avoid pregnancy, consult a healthcare professional for medically appropriate guidance.

In case of a medical emergency, contact your local emergency services immediately. Do not delay seeking medical attention based on any information provided by Cythr.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse engineer, decompile, or disassemble the application
• Scrape, harvest, or collect data from the Service by automated means
• Interfere with or disrupt the Service or its infrastructure
• Impersonate another person or misrepresent your identity
• Upload malicious content or attempt to exploit vulnerabilities
• Use AI features to generate harmful, abusive, or misleading content

5. Intellectual Property

The Cythr name, logo, and all visual design elements, code, and content are the property of Cythr and its contributors. You may not copy, modify, distribute, or create derivative works from any part of the Service without prior written permission.

Your personal health data remains yours. We claim no ownership over the data you enter into Cythr.

6. Partner Sharing

Cythr allows you to share cycle data with a linked partner. By enabling this feature:

• You consent to sharing selected cycle information with your linked partner
• You can revoke sharing access at any time
• You are responsible for choosing whom to share data with

7. AI Features

Cythr uses third-party AI providers to power smart logging and insights. When using AI features:

• No personally identifiable information is sent to AI providers
• AI responses are generated suggestions, not medical advice
• AI conversation history is automatically deleted after 30 days
• You may opt out of AI features at any time

8. Termination

We may suspend or terminate your account if you violate these Terms or engage in conduct that we determine is harmful to the Service or other users.

You may delete your account at any time through the app settings or by contacting privacy@cythr.com. Upon deletion, all your data will be permanently removed as described in our Privacy Policy.

9. Limitation of Liability

Cythr is provided "as is" without warranties of any kind, express or implied. To the fullest extent permitted by law, Cythr and its contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

In particular, we are not liable for any health decisions made based on information provided by the Service, including AI-generated insights and cycle predictions.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes through the app or via email. Continued use of Cythr after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.
